Monthly Meeting Agenda
February 2003 -- Wednesday, February 12th: 7pm at SY Jackson.
Dear Friends and Neighbors:
As we're aware, there has been quite a bit of excitement in our area these past
weeks. It will be good to talk face-to-face, and discuss the many important
issues we've dealt with during this time.
The question is: Do we really care enough to continue our positive
activities? We have revitalized the NHPNA. We have done more
this year than in many past years. We have an opportunity to
be a leading organization in this City, working pro-actively rather
than reacting defensively. I ask you to take the time now.
Unfortunately, we must address some ugliness, as the City of Albuquerque prefers
to play nasty with our organization. In November the NHPNA received notice we were possibly
out of compliance with the City's regulations regarding neighborhood associations. They
gave us one week to comply. As president, I forwarded my concerns. On December 2, 2002, the
City revoked our Recognition "R" status. This violated the appropriate statute governing
our organization.
On December 9, 2002, I met with Seth Heath, the individual who forwarded the complaint to the
City. We discussed his concerns. He found the complainants had misjudged
our efforts. Mr. Heath notified the City he was satisfied. Yet the City continues to "punish" our
group, and as you know, Mr. Heath and Councilor Payne established the SY Jackson NA in our
legal boundaries in January. These events not only violate the specific ordinance, they also constitute a
First Amendment violation.
I am preparing a complaint to be filed in the U.S. Federal Court, hopefully by Tuesday. The
following individuals will be named as Defendants:
Martin Chavez, Mayor
Victor Chavez, Director of Planning
Herbert Howell, Division Manager, ONC
Stephani Winklepleck, Senior Administrative Assistant, ONC
Greg Payne, City Councillor District 8
Seth Heath
Amy Hlad
Donna Caldwell
The legal issues are undisputed, but the City is hoping we will crumble and
go away. I don't believe that's the appropriate thing to do. The NHPNA has worked too hard
for too many years. At this time, I still have not received a response from Amy Hlad about
our Treasury and the NHPNA meeting signs. She appears determined to undermine our
progress. If anyone has influence with her, please ask her to reconsider her position. I
don't believe she understands the gravity of her unprofessional, and illegal, actions.
